RotoPlay files suit against Sportingbet for infringement

The Hershey, Pennsylvania-based fantasy games company RotoPlay, Inc. has filed suit against the British publicly listed online gambling company Sportingbet, claiming copyright infringement and unfair competition.

The basis is from two games that Rotoplay has called "Football Lottery" and "Baseball Lottery" where players choose from an extensive list of players to choose who will score the most fantasy points for that given event. There are variations and prizes for those who pick the most correctly over periods of time as well. Not only has Rotoplay said that Sportingbet is infringing, they say that they have downright plagiarized the game, including the HTML code.

The fantasy sports industry, which is growing at a rate of 7-10 percent annually, has approximately 15 to 18 million participants and generates more than $1.5 billion per year in North America according to recent estimations. It was also specifically excluded from the recently-passed Unlawful Internet Gambling Enforcement Act. However, it is apparent that with these figures that RotoPlay stands to lose a significant amount if indeed its claims are correct, and then Sportingbet will be the one who will be losing--alot.
